Jianfeng Lu Charged for Unlawful Arrival In Guam

August 17, 2022- Tamuning, Guam- Jianfeng Lu made his first appearance today in court before Magistrate Judge Judge Jonathan R. Quan where he was formally charged with Failure to Acquire Clearance Requirements, Failure to Deliver a Manifest to A Customs Officer, and Invalid Place of Unloading.


Lu is the first defendant to be charged in connection with what is believed to be a rash of individuals alleged to have unlawfully arrived in Guam from the Commonwealth of the Northern Mariana Islands in recent months. Prosecuting Attorney Matthew Shuck requested $2,000 bail which was granted by Judge Quan. The defendant remains in custody.


According to charging documents and records submitted by the Guam Customs and Quarantine Agency (CQA), the Guam Police Department (GPD) received a report from a concerned fisherman after seeing suspicious activity on Guam’s northern coast. CQA, GPD and Homeland Security Investigations (HSI) responded and located several individuals in the Ritidian area who they believe entered Guam unlawfully via Guam’s coastline. While conducting their investigation, a suspicious vehicle being operated by the defendant drove up to the scene. The defendant was accompanied by a female adult and an infant. After brief interviews, the defendant admitted to officers he had piloted an inflatable boat from the CNMI and landed at Tanguisson Beach a few months back. He also admitted to not having proper documents or submitting proper documents for entry into Guam.


The multi-agency task force created in response to the recent increase in unlawful arrivals into Guam by boat includes CQA, Guam Department of Agriculture, Guam Department of Labor, Guam Fire Department, Guam Homeland Security, GPD, HSI, the Office of the Attorney General, and Port Authority of Guam.
Lu will be arraigned later this month.
