Criminal proceedings resume: Prosecution secures indictment; jail time for other defendant

November 12, 2020 – Tamuning, Guam- The following criminal cases were presented before the Judiciary of Guam:

Frank ‘Ko’ San Nicolas Indicted
The Office of the Attorney General (OAG) presented defendant Frank ‘Ko’ San Nicolas’ cases involving two different victims, CF306-20 and CF564-20, to a grand jury. A true bill was returned in both cases. He was indicted on charges of Third Degree Criminal Sexual Conduct as a Second Degree Felony and Fourth Degree Criminal Sexual Conduct as a Misdemeanor in both cases. San Nicolas was arraigned days later in CF306-20, entering his formal plea of ‘not guilty’ before the court. His arraignment in CF564-20 is expected to take place later this month on November 24, 2020.

Defendant with extensive criminal history sentenced to 8 years in prison for theft of motor vehicle
In a recent sentencing, the court handed down an eight-year prison term in People v. William John Pinaula, CF684-17. Pinaula was convicted by a jury trial for Theft of a Motor Vehicle as a Second Degree Felony.

Prosecuting Attorney Sean Brown said “The sentence handed down by the court was both fair and just when considering the defendant’s criminal history. I want to recognize the victim who was extremely cooperative throughout the duration of the case, as well as the work of the Guam Police Department and OAG investigators and staff.”
